Fair Work Amendment (Protecting Penalty and Overtime Rates) Act 2025

⏱ When Does Overtime Apply?
- Full-time: after 38 hrs/week or 7.6 hrs/day
- Part-time: after contracted hours or 38 hrs/week
- Casual: same thresholds apply despite casual loading
- Outside the award span of hours (e.g. after 6 pm)
- Hours may be averaged if your award permits it
- Cannot average across pay periods to avoid OT
📝 TOIL — Time Off In Lieu
- Must be agreed in writing before overtime is worked
- Accrued at the applicable overtime multiplier
- 1.5 hrs TOIL per 1 hr of time-and-a-half overtime
- 2 hrs TOIL per 1 hr of double-time overtime
- You cannot be forced to accept TOIL instead of pay
- Unused TOIL paid out if employment ends

How to Calculate Overtime Pay in Australia
Overtime pay in Australia is governed by the Fair Work Act 2009 and calculated based on your Modern Award or Enterprise Agreement. The most common formula applies a multiplier to your base hourly rate for hours worked beyond your ordinary hours.
Worked Example — Monday to Saturday Overtime
Base hourly rate: $30.00 | Overtime worked: 4 hours
First 2 hours @ 150%: 2 × $30.00 × 1.5 = $90.00
Next 2 hours @ 200%: 2 × $30.00 × 2.0 = $120.00
Total overtime pay: $210.00 | Super (12%): $25.20
Worked Example — Public Holiday
Base hourly rate: $25.05 | Hours on public holiday: 6 hours
All hours @ 250%: 6 × $25.05 × 2.5 = $375.75
Super (12%): $45.09 | Total cost to employer: $420.84
Under the Fair Work Amendment (Protecting Penalty and Overtime Rates) Act 2025, which received Royal Assent on 30 August 2025, penalty and overtime rates in modern awards cannot be reduced by the Fair Work Commission. These rates are now permanent, protected entitlements for all award-covered workers.
The national minimum wage from 1 July 2025 is $25.05 per hour. The award minimum is $24.10/hr. Most employees are covered by an award that specifies higher base rates than the national minimum. Always verify your specific award rate via the Fair Work Ombudsman's Pay and Conditions Tool (PACT).
